Owner terms — bookhome.ge
1. About these terms
1.1 Who we are. bookhome.ge (the Platform) is run by Geniuses Recruiting LLC, a company registered in Georgia, registration number (identification code) 405728930, registered address Paliashvili St., Tbilisi, Georgia (the Company, we, us).
1.2 Who these terms are for. These terms are an agreement between the Company and you, a person who lists or manages an apartment on the Platform. They apply to every Member, whether Owner or Manager (clause 4.4). Where a clause applies only to Owners or only to the payout recipient, it says so.
1.3 Accepting these terms. You accept these terms when you tick "I accept the owner terms" at your first sign-in, before you create an apartment. When you apply for online payment (clause 8), you confirm that the bank account and the wallet are yours, and you accept Part B (Money) again.
1.4 Related documents. Guests book under the guest booking terms [link], together with your house rules and cancellation rule. Our privacy policy [link] explains how we handle your personal data and that of guests.
1.5 Draft status. Until a lawyer has reviewed these terms, the Platform marks them as a draft. We will ask you to accept the reviewed version (clause 22.4).
2. Words we use
- Apartment: a home you list on the Platform. Each apartment is one unit that one booking occupies at a time.
- Member: a person with a role on an apartment, either Owner or Manager (clause 4.4).
- Payout recipient: the one Owner of an apartment who receives its payouts (clause 4.6).
- Guest: a person who books, or asks to book, an apartment.
- Booking: the whole record of a stay.
- Request: on the free tier, a guest's request to book. You confirm or decline it. It is not a booking until you confirm it.
- Hold: the 30 minutes during which an apartment with online payment keeps the dates for a guest who is paying.
- Online payment: money a guest pays through the Platform, by card or in crypto. The Company receives it, not you.
- Direct payment: money a guest pays you directly, for example in cash or by bank transfer.
- Prepayment: the part of the total that a guest pays online when they book.
- Balance: the rest of the total. The guest pays it to you directly, or online through a payment link.
- Payment link: a link you send a guest so that they can pay part or all of a booking online.
- Manual booking: a booking you enter yourself for a stay arranged outside the Platform.
- Imported booking: a booking or block that we read from your Airbnb or Booking.com calendar.
- Check-in and check-out: the date and time from which the guest can enter, and by which the guest leaves, in the apartment's time zone.
- House rules and cancellation rule: the rules you set for each apartment (clauses 5.5 and 11).
- Fee: our charge for online payment (clause 9).
- Kept: the online payments for a booking, minus refunds and chargebacks.
- Payout: money we send to the payout recipient.
- Refund: money we send back to a guest.
- Review: a payment that we check by hand before we accept or refund it.
- Negative balance: an amount the payout recipient owes us, because we paid out more for a booking than its final payout (clause 12.3).
- Platform admin: a member of our staff with admin rights on the Platform.
- Business day: [a day other than Saturday, Sunday or a public holiday in Georgia].
3. How bookhome.ge works
3.1 The stay is a contract between you and the guest. We are not a party to it. As the operator of the Platform, we do not manage or inspect the apartments listed on it.
3.2 Listing is free. We charge nothing to list an apartment, to take requests or bookings, or for direct payments.
3.3 We collect online payments for you. When online payment is on for an apartment, its Owners appoint the Company as their agent to collect guests' online payments for that apartment, hold them, send refunds under these terms, keep the Fee and pay the rest to the payout recipient. The Company acts for you only for these tasks.
3.4 What guests see. Guests pay no booking fee; they pay your price. At the payment step we show "Processed by Geniuses Recruiting LLC (bookhome.ge) on behalf of <owner>", and card statements show [BOOKHOME.GE]. We give each guest a receipt for money paid through us, marked "collected on behalf of <owner>". Pages of apartments with online payment say "bookhome.ge holds your payment until 24 h after check-in". In the new-owner period (clause 10.4), they say "bookhome.ge holds your payment until after your stay" instead.
3.5 Where the money is. We hold online payments in the Company's own payment-provider account and crypto wallets until we refund them or pay them out. We pay no interest on them.
Part A — Account and listing
4. Account and eligibility
4.1 Sign-in. You sign in only with a Google account that has a verified email address. Your account on the Platform is linked to that Google account. Keep it secure; we recommend Google's 2-Step Verification. If you think someone else has used your account, tell us at once at [support@bookhome.ge].
4.2 Who can list. You must:
- (a) be at least 18 years old and able to make contracts;
- (b) own the apartment, or have the owner's written permission to rent it out and to receive payments for it;
- (c) give us true information about yourself; and
- (d) not be a person we are forbidden to deal with under sanctions.
4.3 Your name. Guests see your first name before they book ("Hosted by <first name>"), but not your last name.
4.4 Roles. Each Member of an apartment has one of two roles:

An Owner invites a Member by email. The invited person must sign in with Google using exactly that email. An invitation link works once, for 7 days. Invitations have daily limits (clause 17.6). Every Owner gets an email when a new Owner joins. Any Owner can remove another Owner or make a Manager an Owner, and every Owner gets an email when this happens. The last Owner cannot be removed, and the payout recipient cannot be removed, or leave, until another payout recipient is set. An apartment always has at least one Owner, so its last Owner cannot leave.
4.5 Responsibility for Members. You are responsible for the people you invite. We may act on the instructions of any Member within their role. Invite only people you trust with your apartment and, if they are Owners, with money.
4.6 One payout recipient per apartment.
- (a) Each apartment has exactly one payout recipient, chosen from its Owners. By default it is the Owner who created the apartment.
- (b) The payout recipient must be verified (clause 8). Until then, the apartment cannot take online payments.
- (c) We pay all payouts for the apartment to the payout recipient only. We do not split payouts between co-owners. A payout to the payout recipient settles that payout for every Owner of the apartment; co-owners settle money among themselves.
- (d) Any Owner can make another verified Owner the payout recipient. Every Owner gets an email, and payouts to the new recipient start no earlier than 72 hours after the change.
4.7 Contact person. Each apartment has one contact person, chosen from its Members, with a phone number and, if you choose, WhatsApp, Telegram and Viber links. Guests see these only after their booking is confirmed: when you confirm a request, or when the payment is confirmed on an apartment with online payment.
4.8 Notices to you. We email the address of your Google account, in the interface language you chose. If you link Telegram, we also send notifications there, so booking details pass through Telegram. You cannot turn off security notices, for example about a new Owner or a change of payout details. We do not notify you when a platform admin acts as you; the audit log records it (clause 18.3). Keep your email address working.
5. Your listing and its content
5.1 Accuracy. You are responsible for everything in your listing: texts, facts (such as the maximum number of guests), amenities, photos, prices, stay rules, check-in and check-out times, the map pin, the exact address and the welcome guide. It must be true, complete and up to date. Keep your calendar correct, and close dates you cannot offer.
5.2 Our approval before the first publishing. Before an apartment goes live for the first time, you submit it for review, and a platform admin approves it, or refuses it and tells you the reason. You can submit it once it has a title, a summary, at least 5 photos, a base price, the maximum number of guests, check-in and check-out times, a contact phone number, a map pin and the exact address. If we refuse it, it goes back to draft; fix what we named and submit it again. Once we have approved it, you can unpublish it and publish it again without a new review, and your later changes go live at once. We can still suspend it (clause 20.3). Our approval means only that the listing looked complete and plausible when we checked it. We do not inspect apartments, and we do not confirm that listings are accurate: that stays your responsibility (clause 5.1).
5.3 Rights in your content. You must own, or have permission to use, every photo and text you upload. People who can be recognised in a photo must have agreed to appear in it. You give the Company a free, non-exclusive licence to store, copy, resize, compress, remove metadata from, translate and show your content on the Platform, in emails to guests and in link previews. The licence lasts while the content is on the Platform, and for [period] afterwards in backups.
5.4 Translations. You write your texts in English, Georgian or Russian. When you save, an external AI service [currently Google Gemini] translates them into the other two languages. Guests see the label "Translated automatically" and can open your original. You can edit any translation. If you change the original, we redo the translations you have not edited, and flag the ones you have. Check the translation of your house rules: guests accept the house rules in their own language at checkout.
5.5 House rules and cancellation rule. You set the house rules and the cancellation rule (clause 11) for each apartment. A guest must accept both before they book, and again before they pay through a payment link. They become part of your contract with the guest, so they must be lawful and fair. Each booking keeps the check-in and check-out times, the cancellation rule and the house rules it was made with, because the guest accepted them. If you change them, the change applies only to bookings made after it.
5.6 Your legal permission to rent. You are responsible for having every right, permit and registration that the law requires to rent out the apartment for short stays. You are also responsible for following the rules on safety and guest registration, your building's or owners' association's rules, your lease or mortgage, and your insurance. We may ask you for proof.
5.7 Prices. Each apartment has one currency, GEL or USD. You cannot change it once you have set prices or taken bookings. The price the Platform shows a guest at booking is the full price of the stay: nightly prices, extra-guest fees, the cleaning fee and any discount. Do not ask a guest to pay more for a booking than the Platform showed, except amounts the law requires you to collect. You must honour the long-stay discounts and promo codes you create. A promo code applies only when every night of the stay falls within its valid stay dates. A booking uses one of the code's uses while it is a hold, a request, confirmed or completed; an expired hold, a declined or expired request, or a cancellation gives the use back. A code that loses to a long-stay discount uses nothing, but still credits its affiliate.
5.8 Welcome guide and codes. The welcome guide gives guests what they need to arrive and stay: the exact address, how to get in, parking, heating and appliances, check-out instructions and emergency contacts.
- (a) Put Wi-Fi details and door, lockbox and alarm codes only in their own fields. We never translate, email or log them, and never send them to any third party.
- (b) Guests see the guide on their booking page once the booking is confirmed. The "getting in" section opens 24 hours before check-in. The guide closes after check-out.
- (c) On an apartment with instant booking and no online payment, "getting in" also waits until you approve the booking.
- (d) Two days before check-in, the guest gets an email with the guide link, the exact address and the check-in time.
- (e) The public map shows only the area of the apartment, not its exact position.
5.9 Honouring bookings. You must give each guest with a confirmed booking the apartment as described, for the booked dates. If you cannot, cancel the booking on the Platform at once, so that the guest gets the refund in clause 11.4. Then help the guest as the law and your contract with them require.
5.10 Guest data you receive.
- (a) When a guest books, or sends a request and confirms their email address, you see their name, country of residence, number of guests, arrival time and message. You see their phone number and email once the booking is confirmed.
- (b) Use guest data only to manage the booking and the stay, and to meet your legal duties. Do not use it for marketing unless the guest has agreed in a way the law accepts.
- (c) Keep guest data secure. Share it only with people who help you with the stay. Delete it when you no longer need it. On the Platform, we anonymise guest data [N] months after check-out.
- (d) When you enter a manual booking, you must have the right to give us the guest's details, and you must tell the guest that we will email them the confirmation and the welcome guide.
- (e) Tell us at once if guest data from the Platform is lost or misused.
6. Prohibited listings and content
6.1 Prohibited listings. Do not list:
- (a) an apartment you have no right to rent out;
- (b) an apartment that does not exist, or that differs in an important way from its description;
- (c) an apartment that is unsafe, or that the law does not allow to be rented out for short stays;
- (d) the same apartment twice, or several units as one apartment; or
- (e) anything other than accommodation.
6.2 Prohibited content. Your texts, photos and messages must not contain:
- (a) false or misleading information, or photos that do not show the apartment;
- (b) content that you copied without permission, or that breaks anyone's rights;
- (c) in listing texts and photos: phone numbers, email addresses, messenger names or links, web links, IBANs, card numbers or crypto addresses, except in the fields the Platform provides for them (contact person, welcome guide);
- (d) content that discriminates against guests, for example because of ethnic origin, religion, nationality or disability;
- (e) content that is offensive, sexual, violent or illegal; or
- (f) malware, spam, or advertising for other services.
6.3 Prohibited conduct. Do not:
- (a) ask a guest to pay before a booking exists on the Platform;
- (b) on an apartment with online payment, ask a guest to pay outside the Platform the part that the Platform collects online, or ask a guest who found you on the Platform to book outside it so that no Fee is due;
- (c) try to get around contact masking, for example by spelling out a phone number;
- (d) send a payment link for anything other than a real stay at the apartment (clause 7.6);
- (e) help a visitor get around country restrictions (clause 19);
- (f) create fake bookings or several accounts, for example to avoid a suspension or the new-owner limits (clause 10.4); or
- (g) misuse the Platform, for example by scraping it, overloading it or trying to get into other people's accounts.
6.4 What we may do. If we believe that a listing, a message or your conduct breaks this clause, we may flag or remove content, hide an apartment, hold payouts (clause 10.6), suspend an apartment or your account (clause 20), and report the matter to the authorities where the law requires it. Where we can, we tell you why.
Part B — Money
7. Free tier and online payment
7.1 Free tier. Every apartment can use the Platform without online payment, for free. Guests then pay you directly, and you record on the booking what you received. You choose a booking mode:
- (a) Requests (the default). The guest sends a request and confirms their email address. Only then do you see the request, and the dates are held while you answer. If you do not confirm or decline it within 24 hours of the guest's confirmation, or before check-in if that is sooner, the request expires and the dates are released. We remind you 4 hours before it expires. A request that the guest does not confirm within 24 hours, or before check-in, expires without reaching you. The apartment refuses a request for a stay that starts within 2 hours.
- (b) Instant booking without payment. Guests book at once and pay nothing online. Anyone can book this way, so fake bookings can block your dates. You accept that risk.
7.2 Direct payments. You tell guests how to pay you directly in the field "How guests pay you directly", for example "cash in GEL on arrival" or "bank transfer before arrival". Guests see it at checkout, on their booking page and in emails. Do not put account numbers in that field; send them to the guest after the booking is confirmed. We take no part in direct payments: we do not receive them, refund them or settle disputes about them, and they carry no Fee.
7.3 Online payment. Online payment lets guests pay through the Platform:
- (a) by card, through Paysera, in the apartment's currency (GEL or USD); or
- (b) in crypto: USDT on TRON, USDT on TON, or BTC (clause 13).
Online payment works only through the Company's own accounts. You cannot connect your own payment account. We may switch a method off for a time, for example card payment until our payment provider is ready; guests can then pay online only with the other method.
7.4 Turning it on. You can turn on online payment for an apartment when:
- (a) the apartment is published;
- (b) its payout recipient is verified (clause 8); and
- (c) you have set a prepayment of 1% to 100% of the total after discount, and a cancellation rule (clause 11).
Crypto is offered only if the payout recipient has a USDT wallet on file.
7.5 How bookings work with online payment.
- (a) Every booking is instant. The dates are held for 30 minutes while the guest pays.
- (b) Each guest pays at least the prepayment when they book, and may choose to pay the full amount.
- (c) A booking is confirmed only when we receive the payment: for a card, when Paysera confirms it to us; for crypto, when the transfer is final on the blockchain (for BTC, at 2 confirmations).
- (d) If no payment arrives in time, the hold ends and the dates are released.
- (e) A late, wrong or duplicate payment, or a payment for dates that are no longer free, goes to review. A platform admin then confirms the booking if the dates are still free, or refunds the guest. Any amount paid too much or twice is refunded. You do not need to act. While a payment is in review, the dates may not be held; a payment that arrived on time keeps them for up to 12 hours, unless it is a crypto payment that arrived short. A card payment that is less or more than the amount due is always refunded. A crypto payment that arrives short is never accepted, however small the difference: we refund the full amount received, in the coin it came in, and pay the network fee ourselves. On a new booking, the short payment does not keep the dates: unless the full amount arrives in time, the hold ends as if unpaid, and the guest can book again. A booking that is already confirmed, for example through a payment link, stays confirmed, and the guest can pay again through the link while it works.
- (f) The guest pays the balance to you directly, unless you send a payment link for it.
7.6 Payment links. While online payment is on, you can send a guest a payment link for any booking on the Platform, including a manual booking. The link asks for the prepayment, or for everything not yet paid. On a manual booking, the prepayment is the apartment's prepayment percentage of the price you entered, rounded like any other prepayment.
- (a) The Fee applies to money paid through a payment link.
- (b) Before paying, the guest sees the dates, the amount, your house rules and your cancellation rule, and accepts them.
- (c) A link works until check-in, until you send a new link for the same booking, or until the booking is cancelled, whichever comes first.
- (d) In the new-owner period, a payment link on a manual booking can ask for at most USD 300 or GEL 800 (clause 10.4).
- (e) Do not send a payment link for a stay that Airbnb, Booking.com or another platform has already charged for.
- (f) Anyone who has a payment link can pay through it and open the booking, including its welcome guide once it opens. Send each link only to your guest. If the booking has no email address, the payment page asks the guest for one.
- (g) Our email with the link contains only our fixed text. A note you write for the guest appears on the payment page, not in the email. Payment-link emails have a daily limit (clause 17.6).
7.7 When online payment stops. If you turn online payment off, or the payout recipient stops being verified, new bookings for the apartment use a free-tier booking mode. Bookings already paid online are not affected: we refund and pay them out under these terms.
8. Verification for online payment
8.1 What you give us. To take online payments, the payout recipient gives us:
- (a) a photo or scan of their passport or ID card;
- (b) an IBAN for a bank account in their own name;
- (c) proof that the apartment exists, such as a link to its Airbnb or Booking.com listing (if it is not listed anywhere, we agree another proof with you); and
- (d) if they want crypto payments, a USDT wallet address on TRON or TON.
You confirm that the bank account and the wallet belong to you.
8.2 Our decision. A platform admin approves or refuses each request and tells you the reason. We aim to answer within [2 business days]. We may ask for more information. We may refuse if we cannot verify you, or if approving would break the law or our payment provider's rules. A refusal does not affect your listing: it stays published and takes requests.
8.3 Your documents. We encrypt verification documents, and also your IBAN and wallet address. Only the staff who check verifications can open the documents, in a viewer on our admin site that allows no download, and we record every view. We delete the documents 30 days after our decision, and keep the decision and the name of the person who made it.
8.4 More apartments. Our approval covers the payout recipient. Before you turn on online payment for another apartment, we may ask for proof that it exists.
8.5 Changing payout details.
- (a) A new IBAN or USDT wallet needs our approval again.
- (b) We email every Owner of your apartments about the change.
- (c) We send no payout to a destination that changed in the last 72 hours, or that we have not yet approved. Our approval does not shorten the 72 hours.
- (d) Payouts that fall due in the meantime wait (clause 10.6).
- (e) You can undo the change. This keeps the previous details and ends the hold.
- (f) We may call you, on the phone number you gave us before the change, to check that you made it.
If you did not make a change, write to [support@bookhome.ge] at once.
8.6 Keeping details correct. Keep your verification details correct, and tell us when they change. We may ask you to verify again at any time. If your details become wrong, or we have good reason to doubt them, we may turn off online payment for your apartments; clause 7.7 then applies.
8.7 "Verified owner". Once we approve you, your apartment pages show "Verified owner". It means only that we checked an ID, an IBAN and proof that an apartment exists. It does not mean that we checked the apartment, its quality or your permits.
9. Our fee
9.1 The Fee. For each booking, the Fee is 10% of the money kept: the online payments for the booking, minus refunds and chargebacks. We round it to the smallest unit of the currency (tetri, cent, or 0.000001 USDT); half a unit rounds up.
9.2 Our only charge. Listing is free, direct payments carry no Fee, and guests pay no booking fee. The Fee covers the payment provider's charges and our own costs, so you see one number.
9.3 Prepayment and Fee. A smaller prepayment means a smaller Fee, because guests pay more of the total to you directly. This is allowed.
9.4 Rate. The rate is 10%, unless we agree a different rate with you. On an apartment with several Owners, the rate of its payout recipient applies. Each booking keeps the rate in force when it was made, for all its online payments, including a balance paid later through a payment link. If we change the standard rate, we tell you at least [30] days before, and the new rate applies only to bookings made after the change.
9.5 How we take it. We deduct the Fee from the payout. We do not invoice you separately.
9.6 Full refunds. If all the online money for a booking is refunded, we keep no Fee, and we bear the payment provider's charges.
9.7 Examples. A USD apartment; a stay with a total of $944.50; a 30% prepayment; a 7-day cancellation rule.

In the first case the guest also pays you the balance of $661.15 directly, so you receive $916.16 in total.
10. Payouts
10.1 What we pay. For each booking and each currency, the payout is the money kept, minus the Fee, minus anything already paid out for that booking. A refund that is due but not yet sent already counts as refunded. We also deduct any negative balance (clause 12.3).
10.2 When a payout is due. A payout is due 24 hours after check-in. Money that arrives after that, for example after a review, is due on the next daily payout list.
10.3 Where and in which currency.
- (a) Card payments go to the payout recipient's IBAN, in the currency the guest paid (GEL or USD). Use an account that accepts the currency of your apartments.
- (b) Crypto payments go to the payout recipient's USDT wallet, in USDT, on the network of that wallet (TRON or TON). See clause 13.
Apart from converting BTC to USDT (clause 13.4), we do not convert payouts into another currency.
10.4 New owners. For 90 days from the day we approve your verification (the new-owner period):
- (a) money that guests pay online during the period is paid out 7 days after check-out, instead of 24 hours after check-in; and
- (b) a payment link on a manual booking can ask for at most USD 300 or GEL 800.
10.5 Sent by hand. In this version of the Platform, our staff send each payout by hand from the Company's bank account or wallet, and record the bank reference or the blockchain transaction. We aim to send a payout within [1 business day] after it is due. Banks may take [1–2] more business days. We email the payout recipient when we send it. We may automate payouts later; the rules in this clause stay the same.
10.6 When a payout waits. A payout waits while any of these applies. Your dashboard shows the reason.

10.7 Payout details are your responsibility. We send payouts to the details on file. If those details are wrong, or the wallet is on another network, the money can be lost, and crypto transfers cannot be reversed. We are not responsible for losses caused by details you gave us, but we will help you try to recover the money.
10.8 Transfer costs. We pay the costs of sending a payout from our side, including blockchain network fees. Charges your own bank makes for receiving money are yours.
10.9 Checking payouts. Each payout email shows the money paid online, refunds, the Fee and the payout. Your dashboard shows your payout history. Tell us within [60] days if you think a payout or a refund is wrong. If we paid you too much by mistake, you must pay back the difference. If we paid you too little, we pay the difference. We never change past entries; we correct them with a new entry.
10.10 Failed payouts. If a payout fails, for example because the account is closed, we keep the money for you and contact you.
11. Refunds and cancellations
11.1 Your cancellation rule. For each apartment with online payment, you set a number of days, N. If the guest cancels before the deadline in clause 11.2, we refund everything they paid online. If they cancel later, the prepayment is not refunded. If N is 0, the prepayment is never refunded.
11.2 The deadline. The deadline is midnight (00:00, Tbilisi time) at the start of the date N days before the check-in date. Guests see the last day on which they can cancel for free, for example "Free cancellation until the end of 9 Jan 2027 (Tbilisi time)" for a check-in on 17 Jan 2027 with N = 7.
11.3 Money above the prepayment. If a guest paid more than the prepayment online and cancels after the deadline, we refund the part above the prepayment.
11.4 If you cancel. If you cancel a booking, the guest always gets back everything they paid online, and we keep no Fee. If we had already paid out for the booking, that payout becomes a negative balance (clause 12.3). You must also give back any money the guest paid you directly. Cancel only through the Platform, so that the guest gets the refund. If you cancel bookings often, we may suspend the apartment (clause 20).
11.5 Other refunds. We also refund a guest when a review ends in a refund (for example, a late payment for dates that are no longer free), when a guest pays too much or twice, and when the law or a court requires it.
11.6 How we refund. The Platform calculates each refund. In this version, a platform admin sends it by hand:
- (a) for a card payment, to the same card, through Paysera;
- (b) for a crypto payment, in the coin and on the network the guest paid with, to an address the guest confirms with a code we email them. We pay the network fee. A USDT payment is refunded as the refundable share of the USDT received, with no exchange rate, even on a GEL apartment. A BTC payment is refunded in BTC, as the refundable share of the BTC received, so the guest bears any change in the BTC price. For your payout, a BTC refund counts at the conversion we recorded (clause 13.4), so a later change in the BTC price does not change your payout.
We take refunds from the newest payment first, in that payment's currency and method. We tell guests that we send refunds within 7 days, and that their bank may take up to 10 more days.
11.7 Direct payments. We do not refund money a guest paid you directly, including on free-tier bookings. You settle it with the guest.
11.8 Other refunds are yours. We send refunds only as this clause says. If you agree any other refund with a guest, for example for a problem during the stay, you pay it yourself.
12. Chargebacks and negative balances
12.1 Chargebacks. A guest's bank can reverse a card payment (a chargeback), sometimes months after the stay. If that happens:
- (a) the reversed amount no longer counts as kept, so no Fee is due on it;
- (b) if we have not yet paid out, we reduce the payout; and
- (c) if we have already paid out, we recalculate the payout, and anything we paid out above the new payout becomes a negative balance.
12.2 Disputes. We may dispute a chargeback with the guest's bank through Paysera. You must give us the information we ask for, such as proof of the booking, messages and proof of the stay, within [5 business days]. If the dispute succeeds, the money counts as kept again and we pay it out.
12.3 Negative balances. A negative balance arises when we have paid out more for a booking than its final payout, for example after you cancel, after a chargeback, or after a correction. The payout recipient owes it to the Company.
- (a) We deduct it from the next payout to the same payout recipient in the same currency, whichever apartment that payout is for.
- (b) We do not convert between currencies to settle it.
- (c) If no payout in that currency covers it within [30] days, we may ask the payout recipient to pay it, and they must pay within [14] days to the account we name.
13. Crypto payments
13.1 Coins. Guests can pay in USDT on TRON, USDT on TON, or BTC. We may switch off any network at any time, for example when a data provider fails.
13.2 Price. At checkout we convert the price into the coin and lock the rate for 30 minutes. For GEL we use the National Bank of Georgia's official rate to USD; we count 1 USDT as 1 USD; for BTC we use a public exchange price. To tell payments apart, we may ask a guest to pay up to 0.99 USDT more than the price. The amount we receive counts as paid.
13.3 Payouts in USDT. We pay out crypto money in USDT to the payout recipient's wallet, whatever the apartment's currency. The value of USDT can change against GEL and USD.
13.4 BTC is converted on arrival. When a BTC payment arrives, our staff sell it for USDT by hand. The Fee and the payout are calculated on the USDT we actually receive, after the exchange's charges. This can be more or less than the value of the BTC at checkout. The payout waits until we record the conversion. A BTC payment is refunded in BTC from a small BTC reserve that we keep, and for your payout the refund counts at that conversion (clause 11.6).
13.5 Custody. The Company holds crypto in wallets it controls. No private key is kept on any server. In this version we use hardware wallets with a single signature. When our receiving wallets hold more than the value of USD 5,000, we move the excess, by hand, to a wallet that needs 2 of 3 signatures.
13.6 Risks. We rely on public blockchain data providers, each with a backup. Networks and providers can be slow or fail, so payments can be delayed or go to review. Crypto sent on the wrong network or in the wrong coin can be lost; we warn guests about this before they pay. We are not responsible to you for such losses unless we caused them.
14. Taxes and records
14.1 Your taxes. You are responsible for all taxes and charges on your income from the apartment, including the money we collect for you, and for any registration this needs. We do not take tax off payouts.
14.2 Receipts. We give guests a receipt for money paid through us, marked "collected on behalf of <owner>". You give guests any other receipt or invoice the law requires, including for direct payments.
14.3 Records. Your dashboard shows payouts, the Fee and monthly reports. Keep your own records as the law requires.
14.4 Authorities. Where the law requires it, we may give tax or other authorities information about you, your apartments and your payouts.
Part C — Platform rules
15. Calendar sync
15.1 How sync works. The Platform syncs your calendar with Airbnb and Booking.com through iCal links, in both directions.
- (a) You paste the export links of your Airbnb and Booking.com calendars. We read them every 5 minutes.
- (b) We give you a secret export link for each channel. It shows your confirmed bookings, the dates you closed, and the dates imported from the other channel, but not those imported from that same channel. It never shows requests or 30-minute holds, so the dates of a request stay open on Airbnb and Booking.com until you confirm it.
- (c) We always import Airbnb's "Not available" blocks, except the block that only marks the end of Airbnb's booking window.
15.2 Limits of iCal. iCal carries dates only, not names or prices. Airbnb and Booking.com read our export on their own schedule, sometimes only every few hours. Until they do, they can still sell dates that were booked on the Platform. Booking.com may refuse our export link. Then you must close the dates on Booking.com by hand after each booking; each new-booking notification lists the dates to close.
15.3 Double bookings remain possible. The Platform never accepts two overlapping bookings made on it. It cannot prevent an overlap with a booking from Airbnb or Booking.com. If one happens, we alert you at once by email and Telegram, and you must sort it out with the guests. If you cancel a Platform booking to do so, clause 11.4 applies. We are not responsible for double bookings caused by the limits of iCal or by other platforms.
15.4 Your part. Keep your links connected and your calendars correct, and act on the alerts we send. A failed or empty read never frees dates on the Platform. Keep your export links secret. If one leaks, create a new one; the old one then stops working.
15.5 Other platforms. You must follow the terms of Airbnb, Booking.com and any other platform you use. We are not connected with them.
16. Affiliates
16.1 What they are. You can create affiliates: people or businesses that send you guests, such as a ski school. Each has a name, an optional email, a commission percentage and a code. Affiliates never sign in to the Platform.
16.2 Credit.
- (a) An affiliate's link points to one of your apartments. A visitor who opens it is credited to that affiliate for 30 days. If they open several links, the last one counts.
- (b) A code the guest types at checkout counts over a link.
- (c) Credit counts for bookings made on the Platform, on any apartment where you are an Owner. Manual and imported bookings do not count.
- (d) Credit does not depend on which discount applied.
16.3 Commission. Commission is the affiliate's percentage of the booking total. It is earned only after the guest checks out. A cancelled booking earns nothing. The Platform shows what you owe each affiliate.
16.4 You pay affiliates yourself. You pay commission directly, outside the Platform, and then mark it paid. We never pay affiliates or take commission from payouts, and we are not a party to your arrangement with them. You are responsible for that arrangement, for any tax on it, and for the affiliate's personal data that you enter.
16.5 Tracking. Credit relies on a cookie that holds only a random id. If a visitor blocks or clears cookies, the visit may not be credited. The amounts the Platform shows are a guide, and we are not responsible for missed or wrong credit. [D39: no cookie banner; the lawyer confirms.]
16.6 Their conduct. Make sure your affiliates promote your apartments lawfully and do not present themselves as bookhome.ge.
17. Messaging
17.1 Conversations. A guest who has signed in can message you about an apartment before booking. All Owners and Managers of the apartment see the conversation, and any of them can reply. Messages are text only. You can block a guest.
17.2 Contact masking. Until a guest has a confirmed booking for the apartment, the Platform hides phone numbers, email addresses, and messenger names and links in messages, in both directions, and shows "[shown after booking]" instead. Once the booking is confirmed, both sides see the earlier messages in full. Email and Telegram notifications are masked in the same way. Masking is automatic: it can miss details, or hide harmless text.
17.3 Rules. Before a booking is confirmed, do not get around masking, ask for payment, or move the guest to another channel (clause 6.3). Be respectful: no harassment and no discrimination.
17.4 Blocked countries. Visitors from blocked countries cannot send messages (clause 19).
17.5 Admin access. Platform admins can read conversations (clause 18.2).
17.6 Emails we send for you. Some of our emails go to addresses that nobody has confirmed yet: invitations to new Members, and emails to the guest of a manual booking, such as a payment link. These emails contain only our fixed text, people's names and the apartment's name, with no links in the names and no text of your own. Each Owner can send at most 10 invitations and 20 payment-link emails a day, and can re-send an invitation once every 10 minutes.
18. Admin access and audit
18.1 Platform admins. Platform admins are members of our staff. They work on a separate admin site behind Cloudflare Access, and sign in with Google 2-Step Verification as a second factor.
18.2 Reading messages. A platform admin can read any conversation, including the text that masking hides, only to prevent abuse and fraud. Admins cannot write in conversations. The audit log records each time an admin opens a conversation. Our privacy policy tells guests and owners about this.
18.3 Acting as you. A platform admin can act as any Owner, only to give support, for example when you ask for help.
- (a) The admin must record a reason, which the audit log keeps with the session. We do not email you when an admin starts or stops acting as you; you can ask us for these sessions and their reasons.
- (b) The admin has your Owner rights only. Payout details, the payout recipient and Members are read-only, and the admin cannot send messages in your name.
- (c) The admin acts as you only on our separate admin site, inside the admin's own session with its second factor. The admin never signs in to bookhome.ge as you.
- (d) A banner shows that an admin is acting as an owner. The session ends when the admin stops it or signs out, and at the latest after 8 hours.
- (e) The audit log records every page opened and every change made, with the admin's id and yours. You can ask us for the list of changes.
- (f) We are responsible for changes an admin makes while acting as you, unless you asked for them.
18.4 Audit log. The audit log records every time an admin, or someone acting as an owner, reads a conversation, a verification document or a guest's contact details. It also records every act-as session with its reason, every apartment approval or refusal, every money action, every change to an apartment's settings (including online payment, prepayment, the cancellation rule and instant booking), and every change to payout details, the payout recipient, Members, fees, country lists, verification, suspensions and admin rights. It is append-only: no one can change or delete entries through the Platform. We keep it for 5 years, then delete the oldest entries by period.
19. Country restrictions
19.1 Who decides. The Company decides from which countries guests can book. A platform-wide default list is copied to each new apartment, and each apartment has its own list. Only platform admins can see or change these lists; you cannot. The default list includes Iran, Iraq, North Korea and the countries our payment provider refuses [list to come from Paysera].
19.2 How it works. We take the visitor's country from our network provider, Cloudflare. Some networks, for example in Russia, cannot reach Cloudflare, so guest pages are also served through a second server of ours outside it; for its visitors, we look the country up in a GeoIP database that we keep. A visitor from a blocked country sees every date as unavailable, with no explanation, and cannot book or send messages. At checkout we also check the country code of the guest's phone number and the country of residence they give. Visitors whose country is unknown, or who use Tor, are allowed by default.
19.3 Limits. Visitors who use a VPN can get through. The restrictions reduce this risk but do not remove it.
19.4 Your part. Follow the sanctions and other laws that apply to you, and do not help anyone get around the restrictions.
Part D — Account changes and legal terms
20. Suspension and termination
20.1 Unpublishing. You can unpublish an apartment at any time. It then takes no new bookings. Existing bookings stay valid: honour them, or cancel them under clause 11.4.
20.2 Closing your account. To close your account, write to [support@bookhome.ge]. We close it once all your bookings have ended or been cancelled, and all payouts and negative balances are settled. You can leave an apartment at any time, unless you are its last Owner, or its payout recipient before another payout recipient is set (clause 4.4).
20.3 Suspending an apartment. We may suspend an apartment that breaks these terms, for example because its listing asks guests to pay outside the Platform, has false or copied content, or draws repeated complaints from guests. Then:
- (a) its page is hidden, and visitors see a neutral "not available" page;
- (b) new bookings, requests and messages are refused;
- (c) existing bookings stay valid: guests keep their booking pages, guides and your contact details, and you keep managing those bookings in your dashboard;
- (d) refunds and payouts for existing bookings continue under these terms, subject to clause 10.6; and
- (e) we email every Owner the reason. When you have fixed the problem, write to us, and we will decide whether to restore the page.
20.4 Suspending your account. We may suspend your account for a serious or repeated breach of these terms, for suspected fraud, or when the law requires it. Then all your apartments are hidden and take no new bookings, and you cannot open the dashboard. Existing bookings stay valid. Our support team manages them during the suspension and writes to their guests as bookhome.ge, never in your name. Their payouts are paid as usual, unless we suspended your account for suspected fraud; then we hold them until we decide.
20.5 Ending these terms. We may end these terms with you:
- (a) at once, for fraud, a serious breach, or a breach you do not fix within [14] days after we ask; or
- (b) for any other reason, with [30] days' notice by email.
Your apartments are then hidden, and we close your account as clause 20.2 says. Existing bookings stay valid, unless clause 20.6 applies.
20.6 Protecting guests. If an apartment does not exist, cannot be provided, or was listed by fraud, we may cancel its bookings and refund the guests in full. The payout recipient owes us anything already paid out for those bookings (clause 12.3).
20.7 What continues. Clauses 5.10 (guest data), 10 to 14 (money), 21 (liability) and 23 (law) continue after these terms end, for as long as needed.
21. Limits of liability
21.1 Not a party to the stay. We are not responsible for the apartment, the stay or what guests do, such as damage, injury, noise, theft, no-shows or unpaid balances. The Platform takes no damage deposits and provides no insurance. Settle these matters with the guest, and consider your own insurance.
21.2 The Platform as it is. We provide the Platform as it is and as available. We try to keep it working, but we do not promise that it will always be available or free of errors. It depends on services we do not control, including Google, Paysera, Cloudflare, blockchain networks and their data providers, email and Telegram, Airbnb, Booking.com and the translation service. We may change and improve features.
21.3 What we are not responsible for. Unless we caused it on purpose or by gross negligence, we are not responsible for:
- (a) double bookings caused by the limits of iCal or by other platforms;
- (b) errors in machine translations;
- (c) details that masking misses, or text it hides by mistake;
- (d) visitors who get around country restrictions;
- (e) losses caused by payout details you gave us;
- (f) changes in the value of crypto or of currencies;
- (g) delays in payouts or refunds within the times these terms state, or caused by banks, Paysera or blockchain networks; or
- (h) loss of profit, loss of bookings, or any indirect loss.
21.4 Cap. Our total liability to you in any 12 months is limited to the Fees we received for your bookings in those 12 months [or GEL [amount], whichever is higher]. This cap does not apply to payouts we owe you, or to any liability that the law does not allow us to limit.
21.5 Your responsibility. You are responsible for claims by guests, authorities or anyone else that arise from your apartment, your listing, your stays, or your breach of these terms or of the law. You will pay us for the losses this causes us, including fines, chargebacks and reasonable legal costs.
21.6 Events outside our control. Neither of us is responsible for failing to meet these terms because of events outside reasonable control, such as war, natural disasters, power or network failures, or orders from authorities.
22. Changes to these terms
22.1 Notice. We may change these terms. We will tell you by email and in the dashboard at least [30] days before a change takes effect. A change that the law requires, or that protects the security of the Platform or of money, may take effect sooner.
22.2 You must accept again. You must accept each new version to keep using the dashboard. If you do not accept, you may close your account (clause 20.2).
22.3 Existing bookings. A change does not alter the price or the cancellation rule of a booking already made, or the Fee rate of a booking already made.
22.4 This draft. If you accepted a draft of these terms, we will ask you to accept the reviewed version before the Platform opens to guests.
22.5 Earlier versions. Earlier versions stay available at [link].
23. Governing law and other terms
23.1 Law. The law of [Georgia] governs these terms.
23.2 Disputes. If you have a complaint, write to [support@bookhome.ge] first; we will try to resolve it within [30] days. If we cannot, the courts of [Tbilisi], Georgia, decide the dispute.
23.3 Language. These terms are published in English, Georgian and Russian. If the versions differ, the [English] version prevails.
23.4 Notices. We send notices to the email address of your Google account. Send notices to us at [support@bookhome.ge] [or a separate address for legal notices].
23.5 Transfer. You may not transfer these terms to anyone else without our written consent. We may transfer them to a company that takes over the Platform, if we tell you first.
23.6 The Platform belongs to us. The Platform, its software and the bookhome.ge name belong to the Company. You may use them only to list and manage apartments under these terms.
23.7 Whole agreement. These terms, the privacy policy and the settings you choose on the Platform are the whole agreement between you and us about the Platform. If a court finds part of these terms invalid, the rest stays in force. If we do not enforce a right at once, we do not give it up.
